Key Updates to CMS Conditions of Participation


Hospitals

  1. Discharge Planning (§ 482.43)Hospitals must establish written policies and procedures for transferring patients to the appropriate level of care, including to other hospitals, as needed. Annual training for relevant staff on these protocols is mandatory.

  2. Emergency Services (§ 482.55)Hospitals must ensure adequate provisions and protocols to meet emergency patient needs, aligned with nationally recognized, evidence-based guidelines. Requirements include:

    • Maintaining readily available equipment, supplies, drugs, blood products, and biologicals for life-saving procedures.

    • Implementing a call-in system for each emergency treatment area.

    • Providing annual staff training, with documented evidence of completion and demonstrated staff knowledge.


Critical Access Hospitals (§ 485.618)

CAHs must also adopt protocols and provisions for emergency services readiness, consistent with evidence-based guidelines. This includes:

  • Annual staff training with documented completion and knowledge demonstration.

  • Using findings from the Quality Assessment and Performance Improvement (QAPI) program to inform ongoing training needs and updates.
